Traffic Crash 60 Day Statute

Pursuant to Florida Statute Section 316.066, traffic crash reports are required to be kept confidential and may not be released to the public until sixty (60) days after the date of the report. This restriction does not apply to persons involved in the crash, their legal representatives, their insurance companies and qualified media members among others. The statute further requires the above-listed exempt persons to provide all of the following documentation in order to obtain a traffic crash report sooner than 60 days after the report is filed:

  1. Current photo identification (or copy if by mail)
  2. Proof of exempt status, and
  3. A sworn statement that the crash report obtained will not be used for any commercial solicitation prior to the expiration of the 60 days.  Download the form.
