Administrative Authority Ordinance

AN ORDINANCE OF THE CITY OF TAMPA, FLORIDA PERTAINING TO THE AMENDMENTS TO CHAPTER 26 "UTILITIES", ARTICLE 1. ADMINISTRATIVE PROVISIONS, SECTION 26-5 (3) "ADMINISTRATIVE AUTHORITY", PROVIDING FOR REPEAL OF ALL ORDINANCES IN CONFLICT; PROVIDING AN EFFECTIVE DATE.

WHEREAS, pursuant to Resolution 2005-899, adopted by City Council of the City of Tampa on July 28, 2005, the City of Tampa entered into a Consent Order with the Environmental Protection Commission of Hillsborough County and the State of Florida Department of Environmental Protection effective August 9, 2005; and

WHEREAS, it is necessary to amend Section 26-5(3) entitled "Administrative Authority" to ensure that the Wastewater Department Director has the legal authority as established in Sections 1-13, 1-14 and 1-15 as the designated Official to enforce the ordinance in newly proposed Article VII on the Grease Management Program. 

WHEREAS, the Consent Order provides in pertinent part that the City will prepare and implement a City of Tampa Grease Ordinance. The ordinance shall include requirements for grease discharge into the sanitary sewer system and monetary penalties for non-compliance with the ordinance; and

NOW THEREFORE,

BE IT RESOLVED BY THE CITY COUNCIL 

OF THE CITY OF TAMPA, FLORIDA:

Section 1. That Article I, Section 26-5 (3) "Administrative authority" is hereby amended by the substitution of the language as follows: (3) For the provisions in Article III and Article VII, the director of the Wastewater Department.

Section 2. That should any part of the Ordinance be declared invalid by a Court of competent jurisdiction, then the remaining parts hereof shall not in any way be affected by such a determination as to the invalid part.

Section 3. That all Ordinances or parts of Ordinances in conflict herewith are hereby repealed to the extent of any conflict.

Section 4. That this Ordinance shall take effect immediately upon becoming law.
