Sale Of Sparklers And Fireworks Within The City Limits

Definitions

image of fireworksFireworks -The term "Fireworks" shall have the same meaning as defined in Section 791.01, Florida Statutes, as now enacted or herein after amended. City Code, Chapter 11, Section 11-4.

Sparklers -The term: "Sparkler" shall have the same meaning as defined in Section 791.01, Florida Statutes, as now enacted or herein after amended. City Code, Chapter 11, Section 11-4.

Registration of manufacturers, distributors, wholesalers, and retailers of sparklers:

All of the above listed persons or businesses, must be registered in accordance with the provisions of Section 791.015, Florida Statutes. Each listed person or business shall possess an active City Occupational License for each respective location.

Locations for manufacturers, distributors and wholesalers:

All the above listed persons or businesses shall be considered and classified as hazardous occupancies.  Structures, permanent or temporarily occupied by such occupancies, shall meet all the restrictions as set forth in City of Tampa Chapter 5, Section 5-176 Chapter 4, Section 408, shall be located outside of the Fire District/Limits.

Locations for Retailers of Sparklers:

Sales of sparklers by a "Retailer"or "Seasonal Retailer" may be in any structure approved by the Fire Marshal. Restrictions as set forth in Section 791.055, Florida Statutes, shall be met.

Permits:

Each location, where there is an activity regulated by Section 791 of the Florida Statutes, shall be required to obtain approval from the Fire Marshal. Approval shall be in the form of a Permit. Permits shall be obtained from the Fire Marshal's Office.

City Code Chapter 11, Section 11-48 (10) (11).

Bond Required, Proof of Liability Insurance:

Proof shall be provided to City of Tampa, Risk Management Office with the permit application, that the City is an additional insured and has liability insurance in the amount of one million dollars, ($1,000,000). City Code Chapter 11, Section 11-49 B. this is required for each location.

Seizure of Illegal Fireworks:

The Fire Marshal or his designee shall seize, take, remove or cause to be removed at the expense of the owner, all stocks of fireworks offered or exposed for sale, stored or held in violation of City Code or Florida Statutes. City Code Chapter 11, Section 11-139, Chapter 20, Section 2005; 791.05, Florida Statutes.

Revocation of Permit:

The Fire Marshal or his designee may revoke any permit issued by him upon finding the applicant violates any ordinance of the City or any State Law. City Code Chapter 11,Section 11-50.
